Regarding the second terms page (policy), please check this topic: Add a second "Terms and Conditions" checkbox on booking form. If you do not have this page added to the header using the basic settings or a custom implementation, then this may be a caching issue. Please disable third-party plugins and customizations (if there are any) and check if this issue persists. If you use a caching plugin, make sure that caching is disabled for logged-in users. Also, check for caching on the part of the hosting provider. As for the latter question, unfortunately, we do not have such information, you should probably contact a lawyer.
